Property Rights and Due Process of Pen Owners Threatened

DABAGFFA members appeal to the Christian heart of Dagupan City Mayor Belen Fernandez to give them a chance for a dialogue before their titled tax paid fish pens are demolished.

We, the members of Dagupan Bangus Growers Fishpond and Fish pen Association (DABAGFFA), hereby appeal to the Christian heart of Dagupan City Mayor Belen Fernandez to give us a chance for a dialogue because our Constitutional Rights of Property and Due Process are threatened by the impending demolition by the city government of our titled fish pens:
THAT a demand letter was sent to us by Emma Molina, head, Bantay Ilog Task Force, informing us that our fish pens are located in an area that is part of the river system;

THAT the letter was arbitrary since it did not give us a chance for a dialogue so we can air our sides on the impending demolition that commences anytime from now;

THAT we occupy roughly 10-hectare of fish pens and represent 60 percent of the famous and sumptuous Dagupan or Bunu-an Bangus (milkfish) in the market;

THAT the demolition will cost us great and irreparable injury and damage as our fish pens are worth tens of millions of pesos that came from our hard earned monies;

THAT ousting us from our titled fish pens will skyrocket the price of the distinctive and sumptuous Dagupan or Bunu-an bangus, at the expense of Dagupenos, as we produced 60 % of the entire specie in the city;

THAT the demolition violates our Constitutional Rights of Property and Due Process since the pens seat on titled properties and sanctioned by other government agencies;

THAT Mayor Fernandez should consider our plight since we were her vigorous supporters in the last mayoral election;

THAT more than 1000 of us direct and indirect workers who earned our livelihood on these pens would be dislocated because of unemployment;

THAT for arguendo sake, if  we illegally built our fish pens, why the city government accept yearly the real property taxes (RPT) we paid from our fish pens and the city even issued us an Aqua Lease Agreement (ALA) for us to operate our pens?;

As we join together in this urgent call we the members of DABAGFFA to hereby affix their signatures hereunder:
